Permission to distribute promotional materials for medicines and medical devices
Do you know that advertising of medicines and medical devices is carried out exclusively subject to permission?
Moreover, it is not just a permission, but also an “Opinion on the results of evaluating the promotional material of a medical device / medicine for compliance with the legislation of the Republic of Kazakhstan”.
This Opinion is issued by the National center for expertise of medicines and medical devices in accordance with the Order of the Ministry of Health and Social Development of the Republic of Kazakhstan dated February 27, 2015 No. 105 “On the Approval of the rules for advertising of medicines and medical devices” (as amended on April 22, 2019). If you decide to distribute ane promotional material without Opinion, you have to take into account article 157 of the Administrative Code of the Republic of Kazakhstan, according to which distributing an advertisement without Opinion entails major penalties.
To obtain the Opinion, it is necessary to submit an application for the expertise of promotional materials to the State Expert Organization. The expertise of promotional materials lasts 20 days from the date of submitting the application. Medicines and medical devices may be advertised only if they have valid registration certificates and certificates of conformity of the Republic of Kazakhstan.
If the promotional materials do not meet the requirements of the legislation, a reasoned refusal is issued, as a result, the process of resubmission of the application begins introducing the changes to the promotional materials.
